A man is trying to sue Whataburger over a mistaken order, only a few years after trying to sue another fast-food chain for the same mistake.

A man, who is the epitome of everything wrong with the 'where there's a blame, there's a claim' culture, is trying to squeeze some money out of Whataburger. He's hoping to sue the burger chain for no less than $250,000 but up to $1 million for the sake of onions.
Demery Ardell Wilson claims that he asked for no onions on his burger. But when he received it, there were, in fact, onions in it. Onions make little old Wilson's tummy hurt. He's apparently incapable of peeling back the top of the bun to check for them, too.
Because of this alleged slip in human error, Wilson wants to sue Whataburger for up to $1 million. However, his desperate attempt to get rich might not be so easy. Turns out, it's not easy to sue over onions.
You Can't Sue Whataburger Without Direct Proof
Whataburger must have people like this all the time, claiming one thing or another. They are more than prepared and have already responded to his lawsuit. Per USA Today, a spokesperson for Whataburger has denied his claims to sue in a document.
They state that they require "strict proof" of not only the burger in question but also his specific order. They also claim that the branch Wilson bought his 'defective' burger from had no way of knowing it "was in a defective or unreasonably dangerous condition at the time."
Hopefully, the greedy onion eater gets shut down and told to get a real job. However, this seems to be a pattern for him. He has also, using the same lawyer, tried to sue Sonic in the past. He also claims that he ordered a burger without onions, and yet got one with onions.
In April 2023, Wilson tried to sue Sonic after it, akin to Whataburger, put onions in his burger. These made him feel sick, which he feels entitles him to hundreds of thousands of dollars. That case got dismissed just a month later. But we'll see if this time he goes to court.
I feel like this is on him at this point. If he is that allergic to onions, simply briefly deconstruct the burger to check if there are any in there.
